Welcome to the Fielder v. Credit Acceptance Corporation (“CAC” Class Action Settlement website).

On December 5, 2007, the Court entered its “Order And Final Judgment”, approving the settlement of this case on the terms set out in the “Memorandum Of Understanding” between the plaintiffs and CAC. Under the terms of the Court’s Order and the Memorandum of Understanding, the settlement became “final” and went into effect on January 19, 2008. Checks were mailed to class members on January 22, 2008. In addition, the process of eliminating or reducing certain judgments and account balances is now beginning. Also, the process of correcting credit reporting on class member accounts is now beginning. More details concerning the expected schedule for these actions are set out in the Order And Final Judgment.

If you are a member of the Class you do not need to take any action in order to receive any payment or benefits due to you under the Order And Final Judgment. If you are a member of the Class and you have not received your check within a few days after January 22, 2008, or if you are having any other problem with the payment, you should contact the Class Administrator (Rust Consulting, Inc.) by calling 1-800-804-7167 and leaving a message, or by sending a letter to “Class Administrator, PO Box 1889, Faribault, MN 55021-7144”. Be sure to include in your letter your full name, your address, a reference to the “Fielder v. Credit Acceptance Corporation” class action settlement, and a detailed statement of any problem you have had regarding the payment.

All Orders that are entered in this case will be posted on this website within a short period of time after they are entered. By the end of April, 2008, Credit Acceptance will be filing a report to the Court about its filings of satisfactions of judgments and corrections of credit reports as provided in the settlement. A copy of that report will be posted on this website. You can follow the progress of this case by watching for additional information on this website.
